Terms of Service

Effective Date: October 31, 2026
Last Updated: October 30, 2026

Welcome to the website of Asset Managers Inc. (“AMI,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of AMI’s website, website content, property information, forms, communications, and other online services that link to these Terms (collectively, the “Site”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree with these Terms, please do not use the Site.

1. About Asset Managers Inc.

Asset Managers Inc. provides commercial and investment real estate services, which may include commercial real estate brokerage, investment sales, acquisitions, dispositions, landlord representation, tenant representation, leasing, financing and lending-related services, market analysis, and strategic real estate advisory services.

Asset Managers Inc.
California Department of Real Estate License No.: 01245832

Responsible Broker: Nicole Astorga
California DRE License No.: 01970401

Individual real estate licensees affiliated with AMI may have separate California Department of Real Estate license numbers, which will be disclosed where required by law.

Nothing in these Terms expands or modifies the scope of any license held by AMI or any affiliated real estate professional.

2. Website for General Information

The Site is intended to provide general information about AMI, our services, commercial real estate opportunities, properties, market activity, financing options, and related real estate matters.

Website content is provided for general informational and marketing purposes only.

Information appearing on the Site should not be considered a substitute for professional real estate, legal, tax, accounting, financial, engineering, environmental, investment, or other specialized advice.

Real estate decisions should be based on appropriate due diligence and the advice of qualified professionals when appropriate.

3. Use of This Website Does Not Create a Brokerage Relationship

Visiting the Site, viewing a property, submitting a contact form, requesting information, subscribing to communications, communicating with AMI, or otherwise interacting with the Site does not, by itself, create a broker-client, agency, fiduciary, advisory, lender-borrower, or other professional relationship between you and AMI.

A brokerage or agency relationship will be established only when the parties enter into the applicable written agreement or other documentation required by law.

Any duties owed by AMI in connection with a specific real estate transaction will be determined by the applicable written brokerage, representation, agency, commission, listing, lease, purchase, financing, or other transaction documents and by applicable California law.

If these Terms conflict with a separately executed written agreement between you and AMI concerning a specific transaction or professional relationship, the separately executed agreement will control with respect to that relationship.

4. Agency Relationships

Depending on a transaction, AMI or an affiliated licensee may act as an agent for a seller, buyer, landlord, tenant, or other party, or may act as a dual agent where permitted by law and with the disclosures and consents required by applicable law.

An agency relationship is not determined merely by your use of this Site.

Any applicable agency relationship will be disclosed and confirmed through the documentation required for the specific transaction.

Users should carefully review all agency disclosures, representation agreements, purchase agreements, lease documents, and other transaction documents provided to them.

5. Property Information Is Not Guaranteed

Property information appearing on the Site may be obtained from property owners, sellers, landlords, tenants, brokers, public records, listing services, third-party databases, service providers, or other sources believed to be reliable.

However, unless expressly stated otherwise in a signed agreement, AMI does not independently guarantee the accuracy, completeness, or current status of information including:

  • Property descriptions;

  • Square footage;

  • Acreage;

  • Lot dimensions;

  • Building size;

  • Unit counts;

  • Occupancy;

  • Rental income;

  • Operating expenses;

  • Net operating income;

  • Capitalization rates;

  • Financial projections;

  • Lease terms;

  • Tenant information;

  • Zoning;

  • Permitted uses;

  • Development potential;

  • Environmental conditions;

  • Property condition;

  • Taxes and assessments;

  • Financing terms;

  • Availability;

  • Pricing; or

  • Other property or transaction information.

All measurements and figures should be considered approximate unless independently verified.

Prospective buyers, sellers, owners, tenants, landlords, investors, and other parties are responsible for conducting their own investigation and due diligence concerning any property or transaction.

You should independently verify information material to your decision before entering into a transaction.

6. Property Availability and Pricing

Properties shown on the Site may be sold, leased, under contract, withdrawn, unavailable, or subject to changes in price, terms, condition, or availability without prior notice.

The appearance of a property on the Site does not constitute a representation that the property remains available.

AMI may modify or remove property information at any time.

No property listing, marketing material, website description, email, social media post, or other communication constitutes a binding offer unless expressly provided in a properly executed written agreement.

7. No Legal, Tax, Accounting, or Investment Advice

AMI is a real estate services company and is not acting as your attorney, accountant, tax adviser, financial planner, securities adviser, engineer, architect, environmental consultant, or other specialized professional unless separately licensed and expressly engaged to provide such services.

Real estate transactions may have significant legal, financial, and tax consequences.

You should consult qualified legal, tax, accounting, financial, environmental, engineering, and other professionals regarding matters requiring specialized advice.

Nothing on the Site should be interpreted as legal, tax, accounting, investment, or securities advice.

8. Financing and Lending Information

AMI may provide or facilitate information regarding commercial real estate financing, lending opportunities, lenders, financing structures, or related services.

Unless expressly stated in a separate written agreement:

  • Financing information presented through the Site is for general informational purposes only;

  • Interest rates, loan amounts, leverage, fees, terms, and programs may change without notice;

  • Financing is subject to underwriting, credit approval, property analysis, lender requirements, documentation, due diligence, and other conditions;

  • Submission of an inquiry or application does not constitute approval;

  • No statement on the Site constitutes a commitment to lend, extend credit, arrange financing, or provide a particular financing structure; and

  • Actual financing terms are determined through the applicable lender and transaction documentation.

AMI does not guarantee that any lender will approve a financing request or that financing will be available on particular terms.

Where additional licensing, regulatory disclosures, consumer notices, or financial privacy notices are required, those disclosures will supplement these Terms.

9. Commercial Real Estate Services and Compensation

The specific scope of AMI’s services, responsibilities, compensation, commissions, fees, and other transaction terms will be established through separate written agreements where applicable.

Real estate commissions and brokerage fees are not fixed by law and are negotiable between the parties.

Nothing on the Site establishes a specific commission, brokerage fee, financing fee, advisory fee, or other compensation arrangement unless expressly stated in a separately executed written agreement.

10. No Guarantee of Results

Real estate markets, financing markets, property values, tenant demand, buyer demand, interest rates, economic conditions, and individual transactions are inherently uncertain.

AMI does not guarantee:

  • The sale or lease of any property;

  • A particular sale price or rental rate;

  • A particular property value;

  • The timing of a transaction;

  • Receipt or acceptance of an offer;

  • Financing approval;

  • Investment performance;

  • Appreciation;

  • Income;

  • Tax treatment;

  • Occupancy;

  • Return on investment; or

  • Any other particular transaction or financial result.

Past transactions, prior results, historical performance, market statistics, case studies, testimonials, or examples do not guarantee future results.

11. Investment and Market Information

Market reports, property analyses, comparable transactions, demographic information, economic information, projections, capitalization rates, investment metrics, and similar materials may contain estimates, assumptions, third-party information, or information that changes over time.

Such information is intended to assist users in evaluating real estate opportunities but should not be the sole basis for an investment decision.

Prospective investors should independently evaluate any investment opportunity, including its risks, financial assumptions, physical condition, financing, leases, market conditions, legal structure, and tax consequences.

Nothing contained on the Site constitutes an offer to sell or solicitation to purchase any security.

12. Digitally Altered and Virtually Staged Images

Some real estate marketing may include photographs or images that have been enhanced, digitally altered, virtually staged, or created using artificial intelligence or other digital tools.

Where California law requires disclosure of a materially altered real estate image, AMI will provide the applicable disclosure and make the original, unaltered image available as required.

Digitally altered or virtually staged images are intended to help illustrate possibilities and should not be interpreted as representations of the property's actual physical condition.

Users should rely on actual property inspections and original property information when evaluating a property.

13. Equal Opportunity and Non-Discrimination

AMI is committed to providing real estate services in accordance with applicable federal and California civil rights and anti-discrimination laws.

Where applicable, AMI does not discriminate in the provision of real estate or housing-related services on the basis of any characteristic protected by applicable law.

Users may not use the Site or AMI's services to request, facilitate, advertise, or participate in unlawful discriminatory conduct.

Nothing contained on the Site is intended to express or imply an unlawful preference, limitation, or discrimination.

14. Communications and Website Forms

The Site may allow you to:

  • Request information;

  • Contact AMI;

  • Inquire about properties;

  • Request a consultation;

  • Submit investment or property criteria;

  • Submit financing inquiries;

  • Subscribe to communications; or

  • Provide other information.

By submitting information, you represent that the information you provide is accurate and that you are authorized to provide it.

Submitting a form does not create a brokerage, advisory, lending, fiduciary, or contractual relationship with AMI.

AMI may contact you in response to your inquiry using the contact information you provide.

Marketing communications will be handled in accordance with applicable law and our Privacy Policy.

15. Sensitive and Confidential Information

Do not submit confidential financial documents, Social Security numbers, passwords, bank credentials, tax returns, government-issued identification numbers, or other highly sensitive information through ordinary website contact forms unless specifically instructed by AMI to use an appropriate transmission method.

If confidential or sensitive documents are required for a transaction, financing request, or due diligence process, AMI may provide instructions for secure document delivery.

Transmission of information through ordinary email or website forms cannot be guaranteed to be completely secure.

16. Electronic Communications

By communicating electronically with AMI, you consent to receive communications electronically where permitted by law.

Electronic communications may include emails, website notices, electronic documents, and other digital communications.

Where applicable law requires a separate consent for electronic signatures, electronic records, marketing communications, or another specific purpose, AMI will obtain the required consent separately.

Electronic communications do not replace any written disclosure, signature, acknowledgment, or transaction documentation required by applicable real estate law.

17. Privacy

Your use of the Site is also subject to AMI's Privacy Policy, which describes how we collect, use, disclose, retain, and protect personal information.

The Privacy Policy is incorporated into these Terms by reference.

Where there is a conflict between these Terms and the Privacy Policy concerning the handling of personal information, the Privacy Policy will govern with respect to that information.

18. Intellectual Property

Unless otherwise indicated, the Site and its contents are owned by or licensed to AMI.

This includes, without limitation:

  • AMI's name and logo;

  • Website design;

  • Written copy;

  • Property marketing materials;

  • Graphics;

  • Photographs;

  • Videos;

  • Market reports;

  • Brochures;

  • Presentations;

  • Branding;

  • Layouts;

  • Data compilations; and

  • Other original content.

The Site and its content may be protected by copyright, trademark, and other intellectual property laws.

You may view and use Site content for legitimate personal or business evaluation of AMI's services or properties.

You may not reproduce, republish, distribute, sell, modify, scrape, commercially exploit, or create derivative works from Site content without AMI's prior written permission, except as permitted by law.

Property photographs or materials supplied by third parties may remain the property of their respective owners.

19. Acceptable Use

You agree not to use the Site:

  • For any unlawful purpose;

  • To misrepresent your identity or authority;

  • To submit fraudulent or misleading information;

  • To interfere with the Site's operation or security;

  • To introduce malware or malicious code;

  • To attempt unauthorized access to AMI systems or accounts;

  • To collect information about other users without authorization;

  • To scrape or systematically extract Site content for unauthorized commercial purposes;

  • To infringe intellectual property or privacy rights;

  • To send spam or unauthorized solicitations;

  • To facilitate unlawful discrimination; or

  • In any manner that may damage AMI, its clients, its systems, or another person.

AMI may restrict or terminate access to the Site when reasonably necessary to protect the Site, AMI, its clients, or others.

20. Third-Party Websites and Services

The Site may contain links to or integrations with third-party websites and services, including listing platforms, mapping services, social media platforms, financing providers, analytics providers, electronic document services, and other resources.

Third-party websites are independently operated.

AMI does not control and is not responsible for their availability, content, privacy practices, security, accuracy, or terms.

Links are provided for convenience and do not necessarily constitute an endorsement by AMI.

Your use of a third-party website or service is governed by that third party's terms and policies.

21. Third-Party Property and Market Data

The Site may display information obtained from multiple listing services, commercial real estate databases, public records, governmental sources, brokers, owners, landlords, service providers, or other third parties.

AMI does not warrant that third-party information is complete, current, or error-free.

Availability, pricing, transaction information, demographic data, property characteristics, market statistics, and other information can change after publication.

Users should verify information independently before relying upon it.

22. Testimonials

Testimonials appearing on the Site reflect the experiences and opinions of the individuals providing them.

Individual experiences vary.

Testimonials do not guarantee that another client will receive the same outcome or that any particular transaction result will occur.

AMI will not knowingly publish a testimonial that materially misrepresents the person's experience.

23. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

AMI DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE FROM HARMFUL COMPONENTS.

AMI DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, TO THE EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NOTHING IN THIS SECTION DISCLAIMS A DUTY OR WARRANTY THAT CANNOT LAWFULLY BE DISCLAIMED UNDER CALIFORNIA LAW.

24. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AMI AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATED LICENSEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING SOLELY FROM YOUR USE OF OR INABILITY TO USE THE SITE.

THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED UNDER CALIFORNIA LAW.

Nothing in these Terms limits any duty AMI owes under an executed brokerage or transaction agreement, applicable fiduciary duty, California Real Estate Law, or another legal obligation that cannot legally be waived.

25. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless AMI and its officers, employees, agents, affiliated licensees, contractors, and service providers from claims, losses, liabilities, costs, and expenses arising from:

  • Your unlawful use of the Site;

  • Your material violation of these Terms;

  • Information or content you knowingly submit in violation of another person's rights; or

  • Fraudulent or intentionally unlawful conduct by you.

This provision does not require you to indemnify AMI for AMI's own negligence, willful misconduct, violation of law, or other liability for which indemnification cannot lawfully be required.

26. California Real Estate Law Controls

Nothing in these Terms is intended to waive, restrict, replace, or modify a right, duty, disclosure, obligation, or remedy imposed by the California Real Estate Law, regulations of the California Real Estate Commissioner, applicable California Civil Code provisions, or other mandatory law.

To the extent a provision of these Terms conflicts with a mandatory legal obligation applicable to AMI or an affiliated licensee, the applicable legal requirement controls.

27. Record Retention

AMI may retain communications, transaction information, brokerage documents, listings, contracts, disclosures, financing information, and other records as required or permitted by applicable law.

California real estate brokers are required to retain certain records relating to licensed transactions for prescribed periods.

A request to delete information does not require AMI to destroy records that AMI is legally required or otherwise permitted to retain.

For additional information concerning personal information retention, please review our Privacy Policy.

28. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law controls.

Subject to any different dispute-resolution procedure contained in a separately executed transaction or brokerage agreement, disputes arising solely from use of the Site will be subject to the jurisdiction of courts of competent jurisdiction in San Diego County, California, to the extent permitted by law.

Nothing in these Terms alters any mediation, arbitration, dispute-resolution, venue, or other provision contained in a separately executed real estate agreement.

29. Changes to the Site

AMI may modify, suspend, discontinue, update, or restrict all or part of the Site at any time.

AMI does not guarantee that any particular property, feature, service, document, or information will remain available.

30. Changes to These Terms

AMI may update these Terms periodically to reflect changes to our Site, services, business practices, technology, or applicable law.

The revised Terms will be posted on the Site with an updated “Last Updated” date.

Changes will apply prospectively unless applicable law permits otherwise.

Your continued use of the Site after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

Material changes requiring additional notice or consent will be handled as required by law.

31. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed where necessary.

The remaining provisions will remain in effect.

32. No Waiver

AMI's failure to enforce a provision of these Terms does not waive its right to enforce that provision or another provision in the future.

33. Entire Website Terms

These Terms, together with AMI's Privacy Policy and any other policies expressly incorporated by reference, constitute the agreement governing your general use of the Site.

They do not replace transaction-specific agreements, brokerage agreements, agency disclosures, confidentiality agreements, financing documents, purchase agreements, lease agreements, commission agreements, or other separately executed contracts.
